ORAL ORDER
1. The petitioner is before this Court seeking for the following reliefs; a. "Issue a Writ in the nature of Mandamus or any other appropriate Writ, Order or Direction and to consider the Representation submitted by the Petitioner vide Email dated 14.08.2024 for grant of share in the death benefits/full and final settlement of her deceased son, Late Santhosh.S Nair at

ANNEXURE-A, and pending consideration of the above representation,
b. Direct the Respondent No.2 not to release the death benefits/full and final settlement payable in respect of Late Santhosh S Nair, in favour of Respondent No.3.
c. Grant such other reliefs that this Hon'ble Court deems fit and proper under the circumstances of this case, in the interest of justice and equity."

The grievance of the petitioner is that the representation submitted by the petitioner for the release of the death benefits of her son has not been considered by respondent No.2, and that there is a likelihood that the entire amount will be released in favour of respondent No.3, the wife of the deceased son.

Learned counsel for respondent No.2 submits that, since all the documents and nominations made by the deceased son, being the name of respondent No.3-Wife, no payments could be released in favour of the petitioner.
4. Faced with the above situation, learned counsel for the petitioner seeks liberty to withdraw the above

petition and file appropriate proceedings in the appropriate Forum. reserving such liberty, the petition stands dismissed.
5. The submission of the learned counsel for the petitioner that the suit would be filed within one week’s from today i.e., on or before 14.11.2025 is placed on record.
6. The interim order granted by this Court is extended until 14.11.2025. It is made clear that if no proceedings are filed by then, the interim order would automatically stand vacated.
7. Liberty is reserved to the petitioner to seek interim relief in both proceedings as and when filed.
