Respondent(s) Through: Coram: Hon’ble Mr. Justice Sanjay Dhar, Judge ORDER 11.07.2025 The grievance of the petitioner which has been projected by him through the medium of present petition is that, he had filed suit against the defendant/respondent way back in the year 2004 but for one reason or the other, the proceedings in the suit are not been concluded till date. The petitioner has sought a direction upon the trial court i.e, Munsiff, Qazigund to decide and dispose of the suit with reasonable dispatch. It is pertinent to mention here that as per case of the petitioner, evidence of the parties has been considered and when the case was ripe for hearing, the respondent/defendant has come up with an application under Order 18 Rule 3 A of CPC which has stalled the decision of the suit. Having regard to the nature of the relief sought by the petitioner, the petition can be disposed of at the threshold itself by extending appropriate direction to the learned trial court. In view of the above, the petition is disposed of with a direction to the learned trial court to decide and dispose of the suit most expeditiously preferably within a period of three months from the date a copy of this order is made available to the said court.
