Ajay Mohan Goel, Judge (Oral) By way of this execution petition, the petitioner is praying for the execution of the judgment passed by this Court in CWPOA No.222 of 2020, titled Asha Chauhan versus Himachal Pradesh Tourism Development Corporation Limited Shimla and others, decided on 24.05.2023. 2. Mr. Shivank Singh Panta, Advocate, has referred to the order passed by the Hon’ble Coordinate Bench in the contempt proceedings that was initiated by the present petitioner, copy whereof is appended with the reply filed by the respondent- Corporation. 3. Having perused the order passed by the Hon’ble Coordinate Bench in the contempt proceedings, this Court is of the 2 considered view that what the petitioner could not gain in the contempt proceedings, is now being attempted to be gained through these proceedings which is not permissible in the light of the express findings returned by the Hon’ble Coordinate Bench that no junior to the petitioner was promoted to the post of Superintendent Grade-I till her retirement. 4. Faced with this situation, Mr. Sparsh Bhushan, Advocate, prays that the petitioner may be allowed to withdraw this petition with liberty to have access to such remedy as observed by the Hon’ble Coordinate Bench in the contempt proceedings. 5.
