JUSTICE PURNENDU SINGH ORAL ORDER 8 11-07-2025 Heard Mr. Dinesh Maharaj learned counsel appearing on behalf of the petitioner and Mr.Akbar Ali, learned APP for the State. 2. The petitioners no.3 and 4 seeks pre-arrest bail in connection with Trial No.1038 of 2024 arising out of Complaint Patna High Court CR. MISC. No.79967 of 2024(8) dt.11-07-2025 2/3 Case No.486 of 2010 registered for the offence(s) punishable under Sections 323/498(A/379 of the Indian Penal Code. 3. Learned counsel appearing on behalf of the petitioners submitted that vide order dated 04.12.2024, petitioners no.1, 2, who are brother-in-law (bhaisur of the complainant) and petitioner no. 5, who is mother-in-law of the complainant, were granted anticipatory bail, whereas, notices were issued to O.P. No.2 for considering the bail application of petitioners no.3 and 4. Vide order dated 04.07.2025, as per the service report, service of notice upon O.P. No.2 was considered to be validly served by this Court. 4. Learned counsel appearing on behalf of the petitioners submitted that petitioners no.3 and 4, who are gotani of the complainant, are innocent and have falsely been implicated in the present case. There is general and omnibus allegation against them. Petitioners have clean antecedents. 5. Learned APP for the State vehemently opposed the prayer for grant of pre-arrest bail. 6. Considering the nature of allegation alleged against petitioners no.3 and 4, which is general and omnibus, petitioners no.3 and 4 are also enlarged on on pre-arrest bail on the similar terms and conditions which was imposed vide order Patna High Court CR.
