1. Mr. Prince Chauhan, learned counsel for the applicant through Legal Aid.
2. Mr. Sandeep Sharma, learned A.G.A. for the State.
3. Present applicant Sachin Rastogi, S/o Sri Dinesh Kumar Rastori is praying for bail in relation to FIR dated 24.11.2024, bearing FIR no. 181 of 2024, registered at P.S. Pantnagar District Udham Singh Nagar which was lodged against unknown person for the offence punishable under Section 309(4) of BNS 2023. On completion of investigation, the present applicant along with Shivam Gupta and Lalit Giri Goswami were charge sheeted for the offences punishable under Sections 3(5), 309(4), 317(2) of BNS 2023.

Learned counsel for the applicant submits that applicant is languishing in jail since 08.12.2024. He further submits that the applicant is not named in the FIR. He also submits that charge sheet has already been filed, as such, there is no need of custodial interrogation of the applicant and the other co-accused, namely, Shivam Gupta and Lalit Giri Goswami have already been enlarged on bail.

On the other side, Mr. Sandeep Sharma, learned A.G.A. have not disputed this fact that charge sheet has already been filed, and, as such, there is no need of custodial interrogation of the applicant and he has also not disputed this fact that other two co-accused have already been enlarged on bail, however, he apprise to this Court that there is one previous case against the applicant in respect of offence punishable under Section 43 read with Section 406 IPC in which he is already bailed out.

6. After hearing the arguments of the
learned counsel for the parties and taking into consideration that charge sheet has already been filed and other two co- accused have already been enlarged on bail, and the applicant is languishing in jail since 08.12.2024, this Court is of the view that the applicant deserves for bail.
7. Accordingly, without expressing any opinion on the merit of the case, the bail application is allowed.
8. Let the applicant “Sachin Rastogi” be released on bail on his executing a personal bond and furnishing two reliable sureties of the like amount to the satisfaction of the court concerned.
