Also heard Mr. M.P. Goswami, the learned Addl. Public Prosecutor, Assam. 2. This is an application under Section 482 of the BNSS, 2023 in respect of Jagiroad P.S. Case No.249/2024. 3. This is the second application for bail after the earlier one was rejected by this Court on 14.02.2025 vide A.B. No.94/2025. 4. In the said order, it was held that the petitioner was a member of a gang of criminals who operate on the National Highway at night and they stop trucks loaded with consignments and run away with those goods. 5. Mr. Goswami submitted that there are incriminating materials against the present petitioner in the Case Diary. 6. Mr. Choudhury submits that the petitioner has been suffering from gallbladder pain and he is unable to take medical treatment because police has been searching for him. He faces unbearable abdominal pain and vomiting. 7. The medical documents have also been furnished in this regard. 8. I have considered the submissions made by the learned counsel of both sides. 9. The earlier bail application was rejected because there were incriminating materials against him in the Case Diary. 10. Today, this Court is of the opinion that since the petitioner has been suffering from unbearable stomach pain, he needs immediate medical treatment. For this reason, his bail application is allowed. 11. It is hereby directed that in the event of arrest in connection with Jagiroad P.S. Case No.249/2024, the petitioner Md. Raizuddin Sheikh shall be released on bail of ₹25,000/- with a surety of like amount to the satisfaction of the arresting authority. 12. The petitioner shall co-operate with police investigating officer as and when Page No.# 3/3 called for. 13. With the aforesaid direction, the anticipatory bail application is disposed of.
