…. Petitioner Mr. A.K. Sahu, Advocate
-Versus-
State of Odisha …. Opposite Party
Mr. P.K. Ray, AGA
CORAM:
MR. JUSTICE R.K. PATTANAIK
Order No.
ORDER 19.12.2025
01. 1. Heard Mr. Sahu, learned counsel for the petitioner and Mr. Ray, learned AGA for the State. 2. Instant petition under Section 483 BNSS is filed for release of the petitioner on bail in connection with Machkund P.S. Case No.70 of 2025 corresponding to G.R. Case No.48 of 2025 pending in the file of learned J.M.F.C., Lamtaput, Koraput on the grounds stated therein. 3. The petitioner is involved in the alleged incident for having removed the nose ring from the informant and caught at the spot. The submission is that the petitioner is having antecedents but is of the year 2013, which are described in the FIR at Annexure-1. With such submission, learned counsel for the petitioner prays for release of the petitioner, who is in
custody from 14th October, 2025, but the same is objected to by Mr. Ray, learned AGA for the antecedents against him. The rejection order i.e. Annexure-2 reveals that the other four criminal cases are of the year 2013 for similar offences. The involvement of the petitioner is prima facie revealed from the FIR, as he has been caught at the spot. But considering the fact that he is in custody since the date of arrest and had been involved in other cases long back and though the investigation is pending, with the objection of the State recorded, this Court is inclined to allow the petitioner to go on bail with stringent conditions. 4. Hence, it is ordered. 5. In the result, petition under Section 483 BNSS stands allowed. Consequently, the petitioner is directed to be released on bail in connection with Machkund P.S. Case No.70 of 2025 corresponding to G.R. Case No.48 of 2025 subject to him furnishing a bail bond of Rs.30,000/-(Rupees thirty thousand) with one solvent surety for the like amount to the satisfaction of learned J.M.F.C., Lamtaput, Koraput, who shall be at liberty to impose such other suitable conditions as deemed just and proper in the facts and circumstances of the case besides the following, such as, he shall attend the P.S. and report the I.O. once in 10 days’ time preferably on Sunday between 10 A.M. and 1.00 PM for the purpose of investigation and stay away from any such nefarious activities after being released with an undertaking furnished in that regard.
