ORDER
The accused Nos.1 to 8 in CC No.507/2018 on the files of the Judicial First Class Magistrate Court-III, Kozhikode, have filed these petitions for quashing the proceedings against them in the said case. The prosecution was launched by the Drugs Inspector, Intelligence Branch, Office of the Assistant Drugs Controller, Kozhikode, against the petitioners alleging violation of Rule 106B of the Drugs and Cosmetics Rules, 1945. 2. The one and only challenge raised against the maintainability of the prosecution is that there is non compliance of Section 38 of the Drugs and Cosmetics Act, 1940, which requires that every rule made under the said Act shall be laid as soon as may be after it is made, before each House of Parliament while it is in session for a total period of thirty days. 3. Heard the learned counsel for the petitioners and the learned Additional Director General of Prosecution representing the State of Kerala. 4.
The learned Additional Director General of Prosecution, by adverting to the Division Bench decision of this Court in State Bank of India v. Unnikrishnan (2020 (5) KLT 1) pointed out that, while dealing with Section 50(4) of the State Bank of India Act, 1955, which is pari materia

with Section 38 of the Drugs and Cosmetics Act, 1940, it has been held in the said decision that the failure to lay the amendment before the Parliament would not render the provision illegal and unenforceable. The learned Judges of the Division Bench of this Court had rendered the aforesaid decision, after dealing in detail with the law laid down by the Apex Court in various decisions pertaining to the same aspect. 5. On a perusal of Section 50(4) of the State Bank of India Act, 1955, it could be seen that the said provision is worded upon the same lines as that of Section 38 of the Drugs and Cosmetics Act, 1940. Therefore, the law laid down by this Court in State Bank of India v. Unnikrishnan (supra) is squarely applicable to the facts and circumstances of this case. Accordingly, I find that the prayer in these petitions to quash the prosecution proceedings against the petitioners, cannot be entertained. In the result, both these petitions are hereby dismissed.
