The present petition under Article 227 of the Constitution of India has been filed by the petitioner with a prayer to issue a direction to the learned Chief Judicial Magistrate, Siddharthnagar, to decide the Complaint Case No. 822 of 2019 (Izhar Khan v. Abdul Mannan), under Section 406, 409 of I.P.C., within stipulated time. Learned counsel for the petitioner submits that petitioner is complainant. Considering the fact that the case has remained pending since 6.9.2021, the cognizance order has been passsed without expressing any opinion on the merits of the case, this application is finally disposed of with a direction to the Chief Judicial Magistrate, Siddharthnagar, to decide the aforesaid case in accordance with law, as expeditiously as possible, without granting any unnecessary or long adjournments to either of the parties, if there is no other legal impediment.
