Petitioner No. 1 claims to be the second wife of late Nayab Khan and it is claimed further that out of the wedlock between them one son Asad (Petitioner No.2) who is a minor was born. 3. It is contended that the respondent No. 3, the first wife of late Nayab Khan has claimed for pensionary benefits who has also one son. 4. Learned Standing Counsel submits that the controversy regarding claim of pension and retirement dues is already engaging attention of the Superintendent of Police,Rampur and the petitioners may approach the said authority who shall be taking final decision in the matter after hearing the parties concerned. 5. In view of the above, since the matter is engaging attention of the Superintendent of Police, Ramput, this petition stands disposed of with the direction of the petitioners to set up a claim before the Superintendent of Police, Rampur. While disposing of the claim for retirement dues of late Nayab Khan and family pension, the Superintendent of Police, Rampur shall consider the rival claims and take an informed decision in accordance with law.
