Learned counsel for the respondent-Insurance Company, on instructions from Ms.Ritika, Manager (Legal), states that the Insurance Company forgoes the recovery rights against the owner and driver of the offending vehicle in view of the settlement arrived at between the parties in connected cases bearing FAO Nos.2573 and 4677-2018.
In view of the above, the impugned order passed by the MACT stands modified to the extent that recovery shall not be effected from the owner and driver of the offending vehicle. The present appeal stands disposed of accordingly.
Pending applications, if any, shall stand disposed of.
