JUSTICE MOHAMMAD NAWAZ ORAL ORDER FIR in Crime No.71/2024 registered at KGF CEN Crime Police Station, for the offence Punishable under Section 66(D) of the Information Technology, Act, 2000 and Section 420 of IPC is sought to be quashed in this petition preferred under Section 528 of the BNSS, 2023. 2. FIR is registered on the basis of a complaint lodged by respondent No.2, wherein, she has alleged that she was cheated by the petitioner to the tune of Rs.7,75,019/-. 3. Learned counsel appearing for the petitioner and respondent No.2 submits that the matter has been - 3 - HC-KAR NC: 2025:KHC:52866 CRL.P No. 16819 of 2025 settled and in terms of the settlement, respondent No.2 has no objection to quash the proceedings. 4. The petitioner as well as respondent No.2 are present before the Court. They have filed a joint affidavit, wherein, it is stated that they have compromised the matter and in terms of the settlement, petitioner has agreed to pay a sum of Rs.7,75,019/-, to respondent No.2, the amount mentioned in the complaint. It is further stated that the petitioner has paid the due sum in two installments, as stated in the joint affidavit. 5. Respondent No.2 / defacto complainant would confirm that the matter has been settled and she has received the entire amount. She submits that in view of the same, she has no objection to close the proceedings. 6. The dispute is purely private in nature, arising out of financial transaction, whereas, the parties have filed joint affidavit reporting settlement. The amount mentioned in the complaint / FIR has been paid by the petitioner to - 4 - HC-KAR NC: 2025:KHC:52866 CRL.P No. 16819 of 2025 the respondent No.2, receipt of which has been acknowledged. In that view of the matter, no useful purpose will be served in continuing the proceedings. Hence, the following:- ORDER i) Application is allowed, consequently, petition is allowed. ii) The entire proceeding arising out of FIR in Crime No.71/2024 of KGF CEN Crime Police Station, KGF, is quashed.
