Nirmolchand, learned counsel appearing for the respondent No. 2. [2] It has been submitted at the bar by the learned counsel appearing for the respondents that during the pendency of this writ petition, the petitioner has retired from service on attaining the age of superannuation and that by efflux of time, the relief sought for in the present writ petition cannot be granted to the petitioner. The learned counsel accordingly submitted that the present writ petition can be closed as infructuous. [3] On the other hand, Mr. Deepak Prasad Sahu, learned counsel appearing for the petitioner submitted that had the prayer made by the petitioner been granted before the petitioner retired from service, the KABOR AMBAM SAPANA CHANU Digitally signed by KABORAMBA M SAPANA CHANU Date: 2025.05.28 16:04:12 +05'30' 2 petitioner will get the financial benefits upon upgradation of the post as Section officer. [4] In my considered view, at this point of time, even if this Court directs for upgradation of the post, the petitioner cannot get the financial benefits upon upgradation of the post as the petitioner had already retired from service. Accordingly, this Court is of the considered view that nothing survives for adjudication in this writ petition and accordingly, the present writ petition is dismissed as infructuous. JUDGE Sapana
