CORAM: HON'BLE MR. JUSTICE V SRISHANANDA ORAL ORDER Parties are present before the Court and they are unable to see eye to eye for amicable settlement. Hence, matter is taken up for final disposal on merits.
2. Wife/petitioner has filed the petition under Section 24 of CPC (hereinafter ‘CPC’ for short) against the husband with the following prayer:
“Wherefore, the petitioner most humbly prays that this Hon’ble Court be pleased to transfer the pending proceedings in MC No.2757/2025 on the file of III Additional Principal Judge, Family Court, Bengaluru to the Court of Hon’ble Principal Family Court, Mysuru for trial and disposal in accordance with law and to pass such other orders as court deems fit in the circumstances of the case in the interest of justice and equity.”

Facts in the nutshell which are utmost necessary for disposal of the petition are as under:
3.1. Respondent/husband has filed a petition under Section 27(d) of the Special Marriage Act seeking dissolution of the marriage in MC No.2757/2025 on the file of Family Court, Bengaluru.
3.2. Wife is seeking transfer of the proceedings to the Court at Family Court, Mysouru on the ground of geographical distance and financial incapacity and also on the ground of rearing of a young child.
4. It is now settled principles of law and requires no emphasis that those parameters are no longer valid parameters for transfer of the proceedings from one Court to another Court in view of the video conferencing facility.
5. If the wife/petitioner files a petition before the Family Court, Bengaluru seeking permission to effectively participate in the proceedings through video conference, learned Trial Judge shall allow the same.

6. With that observations, following:
