With the consent of learned counsel for the parties, the matter is heard at this stage.

The writ petition has been filed for the grant of following substantive reliefs: -
“ a. That respondents may kindly be directed to release the entire arrears to petitioners without any restriction, from the date from which they have been granted higher scale of 1800-3200 on

completion of 12 years of service (w.e.f. 1994) similarly as paid to Sh Hans Raj and others on basis of OA(D) 1035/1994 and thereafter to Sh Dev Raj and others on basis of OA(D) 151/2018. b. That respondents may kindly be directed to grant the revised scale of 1800-3200 exactly on completion of 12 years of service, as done in cases of other similar situated surveyors c. That respondents may be directed to release the revised leave encashment to petitioners which is already fixed as per Annexure P-10(Colly) or petitioners be paid leave encashment strictly as per revised salary, on which petitioners has been fixed after revision of pay scale.”

Learned counsel for the petitioners submitted that he is under instructions not to press Relief No. b. That this writ petition be treated to have been filed only for redressal of petitioners’ grievances in relation to Reliefs No. a & c. Prayer is not opposed for the respondents. Prayer is accepted and the matter has been heard accordingly.

Learned counsel for the petitioners submitted that petitioners’ case for grant of Relief No. a is covered under Gurcharan Singh Jaswal Vs. State of H.P. & Ors.2 and his case qua Relief No. c is covered under Amita Gupta Vs. State of H.P. & Ors.3 Learned counsel further submitted that the petitioners would be content, if the cases of the petitioners for grant of Reliefs No. a & c are considered by the respondents in light of the aforesaid judgments within a time

bound schedule. Learned Additional Advocate General has no objection to this prayer.

Having regard to above submissions but without examining the merits of the matter, this petition is disposed of by directing the respondents to consider and decide the respective cases of the petitioners of Relief Nos. a & c prayed for by them in light of the aforesaid judgments and pass appropriate order in accordance with law within a period of six weeks from the date of receipt of copy of this order. The decision so arrived at, shall be communicated to the petitioners. Pending miscellaneous application(s), if any, also to stand
disposed of.
