THE HON’BLE SRI JUSTICE K. SURESH REDDY CRIMINAL PETITION No. 1836 of 2025 ORDER: As per the directions of My Lord the Hon’ble the Chief Justice, this Criminal Petition has been allotted to this Bench by notice dated 25.3.2025 and the same is treated as part of the roster effective from 26.3.3025. 2. This Criminal Petition, under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘the BNSS’), is filed by the petitioner/Accused No.2, seeking anticipatory bail, in Crime No.05 of 2025 of Nagari Urban Police Station, registered for the offences punishable under Sections 109(1), 49, 126(2) r/w 3 (5) of Bharatiya Nagarika Sanhitha, 2023 (for short ‘the BNS’). 3. The case of the prosecution is that on the evening of 02.1.2025, A1 along with other accused attacked the husband of the de facto complainant and caused injuries to him. It is further alleged that the incident took place at the instance of A2 who is the petitioner herein. On the basis of the said allegation the present Crime has been registered against the petitioner and others. 2 3. Learned counsel for the petitioner submits that admittedly the petitioner has not participated in the attack on the husband of the de facto complainant. The vague allegation is made in the FIR stating that the petitioner asked the other accused to kill the husband of the de facto complainant.. He further contends that the injuries received by the husband of the de facto complainant are simple in nature. He also states that the other accused who participated in the said attack were already granted bail. Hence, he requests this Court to grant anticipatory bail to the petitioner. 5. On the other hand, the learned Additional Public Prosecutor opposed the bail application. 6. Be that as it may, as the petitioner has not participated in the attack and he came to be implicated only on the confession made by the other accused, this Court is inclined to grant anticipatory bail to the petitioner/A2 on certain conditions. 7. The petitioner is directed to surrender before the Station House Officer, Nagari Urban Police Station, on or before 10.04.2025. On such surrender, the Station House Officer concerned is directed to enlarge the petitioner/Accused No.2 on bail, on his furnishing a personal bond for a sum of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties for a like sum each, to his satisfaction. On 3 such release, the petitioner/Accused No.2 is directed to cooperate with the Investigating Officer and also directed not to tamper with the prosecution witnesses in any manner. After release, the petitioner is directed to report before Station House Officer concerned, once in a week i.e., on every Monday between 10.00 a.m. and 1.00 p.m. until further orders. 8.
