I have gone through the affidavit filed in support of the transfer application. I am satisfied that the petitioner has made out sufficient and just cause for seeking transfer, as she is seriously prejudiced and inconvenienced by being compelled to attend the proceedings before the Principal Sub Court, Kancheepuram. 4. The learned counsel for the respondent, on instructions, fairly states that he has no objection and only seeks for dispensing with physical presence of the respondent before the Sub Court, Kumbakonam. 5. In view of the above, the Transfer Civil Miscellaneous Petition is ordered and the proceedings in HMOP.No.189 of 2025 is hereby withdrawn from the file of the Principal Subordinate Court, Kancheepuram and transferred to the file of the Sub Court, Kumbakonam. It is needless to state that since the matter is not being tried by the Family Court, physical presence of the respondent is not mandatory on all hearing dates, except where his presence would be necessary for his examination and the respondent is at liberty to engage a counsel of his choice. No costs.
