ORDER: This Criminal Petition u/Sec.482 of Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed by the petitioner/accused seeking pre-arrest bail in Cr.No.11/2025 Kakinada Port Police Station, Kakinada district, registered for the offences punishable u/Secs.109(1), 75(1), 329(4) of B.N.S.
2. Heard learned counsel for the petitioner/accused and the learned Assistant Public Prosecutor representing the respondent/State.
3. The case of the prosecution, in brief, is that, the accused used to harass the victim Oleti Satyaveni sexually to fulfill his sexual desire, from

the last six months. While so, on 13.01.2025, at about 6.30 pm, when the victim was alone in her house, the accused entered into her house and used criminal force against her, insisting her to fulfill his sexual desire and when she refused and pushed him away, then the accused attempted to commit murder by causing severe bleeding injuries on her neck and abdomen with prawns peeler knife with an intent to kill her and when she raised cries, the accused ran away from there. Later, the victim was shifted to Government General Hospital, Kakinada for treatment. Basing on the statement of the victim, a case was registered vide Crime No.11/2025 for the above said offences and investigated into.

Learned counsel for the petitioner contends that this case is foisted against the petitioner and most of the investigation completed and prays to allow the criminal petition.
5. On the other hand, learned Assistant Public Prosecutor opposed to grant anticipatory bail to the petitioner. He submits that investigation is at crucial stage and some more witnesses are to be examined and prays to dismiss the criminal petition.
6. Perused the material on record. As seen from the record eight witnesses were examined and the investigation is still in progress. The allegation made against the petitioner is serious in nature. According to the case of the prosecution on 13.01.2025, at about 6.30 pm, when the complainant was alone in her house, the accused entered into her house and used criminal force against her, insisting her to fulfill his sexual desire

and when she refused and pushed him away, the accused caused severe bleeding injuries on her neck and abdomen with a prawns peeler knife. In support of the allegation, placed photographs of the victim which supports her contention in the report. This Court finds that prima-facie victim may not have any compelling reason to foist false case against the petitioner by sustaining such injuries. In view of the grave nature of injuries and considering the nature of injuries sustained by the victim, this Court is not inclined to grant anticipatory bail to the petitioner.
7. In the result, the Criminal Petition is dismissed.
