JUSTICE R DEVDAS ORAL ORDER The petitioner is aggrieved of the impugned endorsement dated 24.07.2025 at Annexure-H. The petitioner had given a representation to the respondent- Tahsildar, Malavalli Taluk, stating that the petitioner's agricultural land bearing Sy.Nos.256/1 and 256/3 are abutting the Korategere-Bavali State Highway passing through Kirugavalu Village, Kirugavalu Hobli, Malavalli Taluk, Mandya District. It is contended that there is a stretch of government land in between the road margin of the abutting State Highway and the petitioner's land and the petitioner's land is situated about 60 feet away from - 3 - HC-KAR NC: 2025:KHC:37451 WP No. 24977 of 2025 the Highway and there is no direct access to the petitioner's property. In that regard the petitioner is requesting that he may be permitted to create an access to the main road. However, by issuing the impugned endorsement the request made by the petitioner has been rejected on the ground that there is a buffer zone in between the petitioner’s land and the Highway and the same cannot be permitted to be used as an access to the petitioner’s property. 2. Learned Counsel for the petitioner submits that a few months ago the State Government has issued a Circular directing the Revenue Authorities to ensure that access is created to every agricultural land, as far as possible. In that view of the matter, learned Counsel submits that the respondent-Tahsildar should be directed to reconsider the representation given by the petitioner. 3. Accordingly, the writ petition stands disposed of directing respondent No.4-Tahsildar, Malavalli Taluk, to have due regard to the Circular issued by the State - 4 - HC-KAR NC: 2025:KHC:37451 WP No. 24977 of 2025 Government which says as far as possible, access should be provided to each and every agricultural lands in the State. The Tahsildar shall reconsider the representation given by the petitioner, and if required conduct a joint survey to find out if an access could be provided to the petitioner's lands. The entire exercise shall be completed as expeditiously as possible and at any rate within a period of 6 weeks from the date of receipt of a copy of this order. Accordingly, the impugned endorsement dated 24.07.2025 at Annexure-H stands quashed and set aside. 4. Pending Interlocutory Applications, if any, stand disposed of. Sd/- (R DEVDAS) JUDGE DL CT:VC
