The petitioner is before this Court seeking for the following reliefs: a. Appoint an arbitrator as envisioned under part ix of the agreement dated 01/03/2021 at annexure-a and adjudicate upon and determine and bring to finality the disputes that have arisen between the petitioner and respondent. b. Pass any other that this Honble court deems fit in the interest of justice and equity. c. Pass any order to award costs for the filing of this petition. 2. The petitioner and the respondent entered into an agreement of Contract for Security and Safety Consultancy Services which is governed by an arbitration Clause 9 page 17 which is reproduced hereunder for easy reference: Any disputes and/or difference arising out of or relating to this contract including interpretation of its terms will be resolved through joint discussion of the authorized representatives of the concerned parties. However, if the disputes are not resolved by the discussion then the matter will be referred for adjudication to the arbitration of person appointed by the parties at Bangalore in accordance with the Indian Laws. The decision of the arbitrator shall be final and binding on the parties. - 3 - HC-KAR NC: 2025:KHC:51536 CMP No. 355 of 2023 3. Initially notice had been issued by the petitioner on 14.06.2023 raising its disputes which came to be followed by another notice dated 13.07.2023 invoking the arbitration clause and nominating an arbitrator. The said notice having been sent to the address of the respondent has not been received by the respondent. In that background the petitioner had approached this Court. 4. Notice having been issued, though the respondent has been served has chosen not to be represented. 5. A perusal of the Contract for Security and Safety Consultancy Services indicates that the same is governed by an arbitration clause and all the disputes are required to be adjudicated by way of arbitration. Notice having been issued by the petitioner in a proper manner, respondent not having acceded to the same, I pass the following: - 4 - HC-KAR NC: 2025:KHC:51536 CMP No. 355 of 2023 ORDER i) CMP is allowed. ii) Sri.Vedanth Anand Chugh, Advocate, Law Chambers of Vedanth Chugh, No.507, 5th Floor, Prestige Centre Point, Edward Road, Bangalore- 560 052 (Mobile No.99001 32222) is appointed as a sole Arbitrator to arbitrate the dispute between the parties under the aegis of the Arbitration Centre attached to this Court. iii) Registry is directed to forward a copy of this order to the Director, Arbitration and Conciliation Centre for doing the needful. iv) Petitioner shall appear before the Director of Arbitration and Conciliation Centre without requirement of any notice on 16.12.2025 at 2.30 p.m. v) All contentions are left open. vi) Registry is directed to return the original and/or certified copies, if produced, to the respective parties who have produced it/them by following due procedure.
