Nilesh Kumar, Advocate For the State : M/s. Tarun Kumar, A.P.P --- 02/21.03.2025 Heard the Parties. Petitioner has been made accused in connection with Balumath P.S. Case No. 170 of 2023, Spl. POCSO Case No. 30 of 2024, for the offence registered under Sections 363, 365, 354, 376(3) of the Indian Penal Code and Sections 4, 8 & 18 of POCSO Act and thereafter, charge has been framed under Section 363 of the Indian Penal Code and Sections 6/18 of POCSO Act, pending in the court of learned Special Judge, POCSO, Latehar. Bail application of the petitioner was earlier rejected by this court vide B.A. No. 7152 of 2024 by order dated 24.10.2024. On 27.11.2023, petitioner and co-accused persons kidnapped 14 years old girl and thereafter, co-accused Sonu Kumar Singh is alleged to have raped her. Attention has been drawn towards the statement of the victim recorded during trial, in which, she has not identified any of the accused persons and has been declared hostile. It was further submitted that similarly situated co-accused has been granted bail by this court earlier. Regard being had to the facts and circumstance of the case, the petitioner named above, is directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand only) with two sureties of the like amount each to the satisfaction of learned Special Judge, POCSO, Latehar in connection with Balumath P.S.
