Heard learned counsel for the petitioner and learned Standing Counsel for the respondents. 2. The petitioner by means of the present writ petition has prayed for the following relief:- "(i) to issue writ, order of direction in the nature of mandamus commanding the respondent authorities not to interfere in reconstruction of the boundary wall of the house situated in Khasra No.81, area 0.0840 hectare to protect the land from staray animals and for the proper use of land. (ii) to issue writ, order or direction in the nature of mandamus diecting and commanding the respondent no.2 to pay compensation of the illegal demolition of the boundary wall of the house of the petitioner. (iii) to issue writ, order or direction in the nature of mandamus commanding the Sub-Divisional Officer Soraon, District Prayagraj/Respondent no.3 to decide the representation dated 24.01.2025 of the petitioner within stipulated period. (iv) to issue any other suitable writ, order or direction, which this Hon'ble Court may deem fit and proper in the facts and circumstances of the case." 3. It is alleged that the respondents have illegally demolished the boundary- wall of the petitioner. However, learned Additional Chief Standing Counsel on instruction, which is taken on record, states that the petitioner has Versus Counsel for Petitioner(s) : Ramesh Chandra Kushwaha, Sanjeev Kumar, Syed Mohammad Abbas Abdy Counsel for Respondent(s) : Amit Rai, Azad Rai, C.S.C. Anjani Kumar .....Petitioner(s) State Of U.P. And 11 Others .....Respondent(s) encroached upon the road land. Paragraph nos.2 & 3 of the instructions are reproduced herein-below:- " 2. आराजी संख्या 82 सामुदाियक उद्यान खाते की भूिम है जो याची की व्यिक्तगत भूिम नहीं है। इस भूिम के सम्बन्ध में याची द्वारा दीवानी न्यायालय िसिवल जज किनष्ट श्रेणी शकीर् इलाहाबाद में बाद दािखल िकया गया है िजसकी वाद संख्या 1538/2016 अजनी कु मार बनाम उ० प्र० राज्य आिद जो वतर्मान में िवचाराधीन है। िजसमें सुनवाई की अगली ितिथ 18.09.2025 िनयत है। 3. आराजी संख्या 73 सड़क प्रस्तािवत खाते की भूिम है जो याची के आराजी संख्या 81 के पिश्चम िदशा से गयी है। याची सड़क भूिम पर अवैध रूप से बाउन्ड्रीवाल का िनमार्ण कर रहा था िजसे ग्राम वािसयों की िशकायत पर पुिलस बल के माध्यम से हटवा िदया गया है। आराजी संख्या 81 जो िक याची के नाम संकमणीय भूिमधर दजर् है से याची के िकसी भी िनमार्ण को नहीं हटाया गया है।" 4. The question as to whether the petitioner has encroached upon the road land and whether boundary-wall is existing on the plot owned by the petitioner is a question of fact, which cannot be determined by this Court under Article 226 of the Constitution of India. In such view of the fact, this Court cannot decide the dispute raised by the petitioner. 5.
