2. In compliance with the order of this Court dated 18.04.2018, passed in C.W.J.C. No. 14497 of 2009, a show- cause affidavit has been filed on behalf of opposite party nos. 3 and 4, as also on behalf of opposite party no.6.
3. Learned Advocate for the petitioner, referring to the
order under contempt, has submitted that though the Court has taken note of the fact that the petitioner has been extended the
Patna High Court MJC No.2595 of 2022 dt.19-09-2025 2/2 benefit of ACP and, as such, Time Bound Promotion and its consequential benefit is not applicable in the case of the petitioner, but actual monetary benefit has not been given.

The aforesaid fact has been refuted by the learned Advocate for the State by referring to para.17 of the show-cause affidavit filed on behalf of opposite party nos. 3 and 4, which clearly states that the petitioner has already been extended the Assured Career Progression Scheme. He further submits that the present contempt petition is grossly barred by delay, as the order under contempt came to be passed on 18.04.2018 and the present contempt petition has been filed on 16.12.2022.
5. This Court finds substance in the submission advanced by the learned Advocate for the State in view of Section 20 of the Contempt of Court’s Act, 1971; as also the averments made in the show-cause affidavit.
6. Accordingly, this Court does not find any reason to continue with the contempt proceeding; the present contempt petition stands closed.
