Shri Avijit Saxena, learned counsel for the respondent nos. 2-4 submits that the enquiry has been concluded and a show cause notice along with the enquiry report has been served upon the petitioner. An employee is suspended in contemplation of a departmental enquiry and to facilitate such enquiry. Since the enquiry has concluded there is no purpose of keeping the employee suspended for any further period. The impugned order of suspension dated 01.05.2023 is quashed. The petitioner shall be forthwith reinstated in service. The writ petition is allowed with the above observations.
