2 The Court made the following Order:
1. The petitioner is arraigned as an Accused No.4 in Crime No.164 of 2024, on the file of Yalamachila Police Station, West Godavari District, for alleged offence under Sections 85 and 82(1) of the Bharatiya Nagarik Suraksha Sanhita, 2023, (for short,
“BNSS”) and Sections 3 and 4 of the Dowry Prohibition Act, 1961, (for short, “DPA”).
2. The learned counsel appearing for the petitioner/accused submits that the petitioner is a stranger to the de facto complainant and the 1st accused. The de facto complainant is married to the 1st accused, and certain marital disputes arose between them. The petitioner is alleged to be an acquaintance of the 1st accused and, as such, he is roped in as Accused No.4 in the present case.
3. The learned Assistant Public Prosecutor submits that the matter is under investigation.
4. Considering the same, the Criminal Petition is disposed off, directing the Station House Officer, Yalamachila Police Station, West Godavari District, to follow the procedure as contemplated under Section 35(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023, (for short, “BNSS”).
