THIS WRIT PETITION IS FILED UNDER ARTICLES 226 AND 227 OF THE CONSTITUTION OF INDIA PRAYING TO ISSUE A WRIT OF MANDAMUS OR ANY OTHER APPROPRIATE WRIT, ORDER OR DIRECTING THE RESPONDENTS TO GRANT PERMISSION TO THE PETITIONER SANGHA TO CONDUCT THE 69TH KANNADA RAJYOTSAVA FUNCTION WITHIN THE BHEL BENGALURU PREMISES ALONG WITH PERMISSION TO HOIST THE KARNATAKA STATE FLAG, AND TO RELEASE THE FUNDS FOR THE SAID EVENT AS HAS BEEN THE PRACTICE FOR THE PAST FOUR DECADES BY CONSIDERING THE PETITIONERS REPRESENTATIONS DATED 18-10-2025 AND 24-10- 2025 IN INTEREST OF JUSTICE AND EQUITY (ANNEXURE-G AND H) AND ETC.
THIS WRIT PETITION, COMING ON FOR PRELIMINARY HEARING, THIS DAY, ORDER WAS MADE THEREIN AS UNDER:

ORAL ORDER
1. The petitioner is before this Court seeking for the following reliefs; a) Issue a writ of mandamus or any other appropriate writ,
order or directing the respondents to grant permission to the petitioner sangha to conduct the 69th Kannada Rajyotsava Function within the BHEL Bengaluru premises along with permission to hoist the Karnataka State Flag, and to release the funds for the said event as been the practice for the past four decades by considering the petitioner’s representations dated 18.10.2025 and 24.10.2025 in interest of justice and equity (Annexure-G and H)
b) Grant such other and further reliefs as this Hon’ble Court deems fit in the facts and circumstances of the case, in the interest of justice and equity.

2. The grievance of the petitioner was that respondent had not granted permission to the petitioner to conduct the 69th Kannada Rajyotsava function within the BHEL premises at Bangalore.

Notice having been issued, respondent has filed its objections categorically stating that there being two rival Sangha, who wanted to conduct the said celebration, the management has decided to conduct the 69th Kannada Rajyostsava function by itself without any of the said rival Associations conducting such a celebration.
4. When the Management itself has come forward to conduct said celebration, any and every employee of BHEL would be entitled to participate in the said function and so long as the function is being organised to celebrate Rajyotsava, it would not matter as to which association or Sangha conducts the said celebration. In this particular matter, the Management conducting the said celebration, the

petitioner cannot have any grievance nor can contend that it would want to conduct the said celebration by itself.

In that view of the matter, no grounds being made out, placing on record the submission of learned counsel for respondent No.1 and 2 that the Management will hold the Rajyotsava celebration on 1st November, 2025, where each and every employee of the organization and their family members can participate, the writ petition stands disposed.
