ORAL ORDER (PER: THE HON'BLE MR. JUSTICE B.M.SHYAM PRASAD)
The complainant asserts that it is an Association incorporated for the purposes of conducting recreational activities, and despite the writ Court’s order dated 03.04.2024 at its instance in W.P. No. 102129/2024, the respondents [the jurisdictional Police Officers] are obstructing it from conducting such activities.
This Court has called upon the respondents to file their response, and such response is filed with photographs. On perusal of these, this Court has directed the complainant to file an affidavit detailing different activities conducted in the subject premises lest there be directions to close the premises in view of the prima facie opinion that the

petitioner has filed the petition in W.P. No. 102129/2024 even without facilities in the place, and perhaps to engage in activities that are not permissible in law.
However, Sri D.M. Malli, the learned counsel for the complainant, has filed a memo for withdrawal of the complaint. Sri D.M. Malli assures this Court that there was a bonafide effort to commence recreational activities though without all the facilities, but the Complainant is willing to place on record that it will close the premises at the earliest and the respondents can act if there is any activity in the subject premises by the Complainant. Taking this submission on record and observing that the Police Authorities will be at liberty to stop all activities [without exception] by the complainant in the subject property, the complaint is closed.
