ORAL JUDGMENT

1. Heard the appellant, who appeared as party-in- person as well as the learned counsel appearing for the respondent.
2. It is the contention of the appellant that he is an ex-service man under the general merit category and that filling up of the post of ex-service man in the reserve category from the persons other than ex-service man vitiates the selection process of ex-servicemen to the post of Second Division Assistant on establishment of High Court of Karnataka under relaxed standard.

3. The learned counsel appearing for the respondents submits that the petitioner had submitted an application under the ex-service man category in the general merit quota. He had not secured the minimum qualifying marks for selection under the ex-service man (general merit) category. It is submitted that the notification itself provided for minimum marks in separate subjects and that the petitioner had not secured the minimum marks in one of the subjects. Further, with regard to filling up of the ex-service SC category and III(A) category, it is submitted that there were no eligible candidates available and that the notification itself permitted filling up of such posts by general candidates, if candidates are not available in the reserved category.
4. It is submitted that these aspects of the matter have been considered by the learned Single Judge. Though extensive records have been produced by the petitioner who appears in person, we are of the opinion that in view of the provisions of the notification and the fact that the

petitioner had not secured the minimum qualifying marks required for selection in the ex-service man category, the further contentions raised in this appeal cannot be considered. The appeal fails. It is accordingly dismissed.
