Coram: Hon’ble Mr. Justice B. Bhattacharjee, Judge
Appearance: For the Petitioner/Appellant(s) : Mr. P. T. Sangma, Adv. For the Respondent(s)
: Mr. S. Dey, Adv. (R: - 1 & 2)
ORAL:-
Heard learned Counsels appearing for the parties.
Mr. S. Dey, learned Counsel for the respondents places on record a copy of the Office Order No.44 dated 19-09-2024 issued by the Secretary, Executive Committee, Garo Hills Autonomous District Council, Tura and submits that this writ petition has become infructuous in view of the fact that the relief claimed for in this writ petition by the petitioners has already been granted to them.
Mr. P. T. Sangma, learned Counsel for the petitioner points out that the
order, which is placed on record by the learned Counsel for the respondents, speaks of implementation of the recommendation of the Meghalaya Fifth Pay Commission only for 1(one) month and there is no indication that the recommendation has been accepted for payment of salary on regular basis.
To clarify the above, the learned Counsel for the respondents submits that though the Office Order No. 44 dated 19-09-2024 relates to the payment of salary for 1 (one) month, the Garo Hills Autonomous District Council has decided to implement the recommendation of the Meghalaya Fifth Pay Commission for payment of salary on regular basis.
The copy of the Office Order No. 44 dated 19-09-2024 is taken on record and marked as ‘X’ for identification. 2025:MLHC:189
In view of the categorical submission made by the learned Counsel for the respondents, it is apparent that no further order is called for in this writ petition as the relief sought for by the petitioners in this case has already been granted to them.
Accordingly, the writ petition has become infructuous and stands
disposed of.
