Learned counsel for the petitioner submits that after the petitioner was arrested in the present case on 24.01.2024, investigation qua him was complete, as challan stood presented coupled with the fact that even charges have been framed. It has also been submitted that since 08 prosecution witnesses still remain to be examined, further incarceration of the petitioner would serve no useful purpose

against the petitioner is based on documentary evidence which is already part of the challan. 3. Per contra, learned State counsel, while opposing the prayer and submissions made by the counsel opposite, has, on instructions, not disputed the custody period of the petitioner, nor has he disputed the stage of the trial. It has also not been disputed that the entire case of the prosecution against the petitioner hinges on documentary evidence which is also already part of the challan. However, learned State counsel has reiterated the allegations levelled against the petitioner in the FIR in question, which is annexed as Annexure P-1, and stands reproduced hereinunder:-
“No.51 date 24-01-2024 COMPLAINT UNDER SECTION 195 CR.P It is respectfully submitted as under:- 1) That in FIR No. 133 Dated 12-12-2023, PS Cantt Ferozepur, under Section 21 of NDPS Act, accused Ramesh @ Mesha has been ordered to furnish bail bonds and surety bonds for releasing him on bail as per order dated 24-01-2024 passed by the court of Shri Kewal Krishan. Ld. Judge, Special Court, Ferozepur in bail application No BA/137/2024. Today applicant/surety Ramandeep Singh son of Jasbeer Singh resident of Heera Mandi, Ferozepur city. Tehsil and District Ferozepur along with Tarlok Singh Numbaerdar son of Sewa Singh resident of House No, 91 Kumar Mandi, Ferozepur Cantt and Robin son of Ramesh @mesha, resident of village Khalchian Qudim. PS Sadar Ferozepur, Tehsil and District Ferozepur appeared before this Court in order to furnish bail bonds and surety bonds in compliance of order dated 24-01-2024. On inquiry, Reader of this Court found that Ramandeep Singh son of Jasbeer Singh was furnishing fake surety in connivance with Tarlok Singh Numberdar and Robin by forging his Adhar Card No. 459625781458 and furnished jamabandi for the year 2018- 2019 bearing Khewat No. 36/40, Khatoni No. 88 hadbast No. 108 situated in the area of Ferozepur city for a value more than 70,000/- and thereby committed an offence punishable under Sections 420,465,467,468,471 IPC read with Section 34 IPC.

When the undersigned was confirming about the fake Adhar Card produced by Ramandeep Singh, in the meantime, Tarlok Singh Numberdar and witness Robin, who at that time present out of the Court, run away. Therefore, action be taken against the above said accused. 2) That myself being complainant is required to appear in the Hon'ble Court personally during proceedings of the above noted case, as I being Judicial Officer will be busy in court work and it will not be possible for me to attend the Hon' ble Court in. person. It is therfore, requested that since I shall be busy in Court work being Judicial Officer, the APP may please be allowed to attend the Hon'ble Court on my behalf on each and every date of hearing in the case. SD/- Balvinder Kaur Dhaliwal, Judicial Magistrate 1" Class, Ferozpur. UID No. PB0286 Dated 24.01.2024. Today above-said order has been received in police station from the court of Sh. Balwinder kaur Dhaliwal JMIC/FZR Ferozpur and accordingly, FIR has been registered against above-mentioned persons and after CCTNS, copy of FIR along with copy of order is kept by ASI himself for investigation. Special reports be prepared and sent by hands of SC Karamjit Singh 1397/FZR to Illaqa magistrate and higher officials. PCR be informed through wireless.”
4. I have heard learned counsel for the parties and perused the material placed on record. 5. The petitioner has been in custody for more than a year, having been arrested on 24.01.2024 in a case hinges on documentary evidence. There can be no possibility of the petitioner tampering with evidence, as it is now all part of the challan. The trial is unlikely to conclude in the near future. 6.
In the facts and circumstances as enumerated hereinabove, this Court deems it fit to extend the concession of bail to the petitioner. 7. Accordingly, the instant petition is allowed and the petitioner be admitted to bail on his furnishing bail/surety bonds to the satisfaction of the Trial Court/Duty Magistrate concerned. anything observed hereinabove shall not be construed to be an expression of opinion on the merits of the case. 8. Needless to add, in case the petitioner misuses the concession of bail granted to him, the State would be at liberty to seek cancellation of the same. (MANJARI NEHRU KAUL)
