ORAL JUDGMENT
(PER: HON'BLE MR. JUSTICE VIJAYKUMAR A. PATIL)
This Contempt of Court Case is filed alleging willful disobedience of the order of the learned Single Judge dated 31.01.2024 passed in W.P. No.18178/2022.
2. The operative portion of the direction of the learned Single Judge reads as under;
"(iii) The respondent – Corporation shall hold a fresh enquiry and after affording opportunity to the petitioners, shall proceed to take appropriate action in the matter.
(iv) The respondent, while holding enquiry, is also bound to take cognizance of Annexures-A and B.
(v) The enquiry shall be concluded within a period of eight weeks from the date of receipt of copy of this order.
(vi) If promotions conferred on the petitioners are upheld, post enquiry the respondent – Corporation is bound to pay difference of salary on account of reversion. Since petitioner No.1 has retired and petitioner No.2 is going to retire, all admissible retirement benefits shall be calculated in terms of post of Assistant Store Keeper."
3. The respondents entered appearance and filed an affidavit indicating compliance of the direction of the learned Single Judge. The affidavit is accompanied with copy of the enquiry notice, enquiry report and an endorsement.

4. In view of the aforesaid documents and the affidavit, we are of the considered view that the order of the learned Single Judge has been complied and there is no willful disobedience of the order. Accordingly, Contempt proceedings are dropped. Notice issued to the respondent/accused shall stand discharged.
It is needless to observe that, if the complainants have any grievance, it is open for them to challenge the same in accordance with law.
All contentions are kept open.
