No.26814/2022 pending on the file of the Court of Additional Chief Judicial Magistrate, Bengaluru Rural District at Bengaluru, are sought to be quashed in this petition, preferred under section 482 of Cr.P.C. 2. Law was set in motion by the second respondent. On her compliant, a case in Crime No.230/2022 was registered at Avalahally Police Station for the offence p/u/s, 506, 498A, 504, 355, 323, 324, 114 r/w 34 of IPC and Sections 3 and 4 of Dowry Prohibition Act, 1961. On completion of investigation, charge sheet was filed against the petitioners. 3. The matter arises out of a matrimonial dispute. It is submitted by the learned counsel for the petitioners and respondent No.2 that the dispute has been resolved by the parties in terms of the memorandum of settlement filed before the Family Court at Bengaluru in - 4 - HC-KAR NC: 2025:KHC:49227 CRL.P No. 11804 of 2024 M.C.No.1145/2023. A joint affidavit is filed, signed by the petitioners and respondent No.2. 4. It is submitted that respondent No.2 filed a petition seeking a decree of divorce against petitioner No.1 in M.C.No.1145/2023 and in the said case, they have entered into an agreement before the Karnataka Mediation Centre, wherein, respondent No.2 has agreed for closure of the present criminal case initiated against the petitioners. 5. The copy of the memorandum of settlement filed before the Family Court at Bengaluru, in M.C. No.1145/2023 as well as the decree passed in the said case, dissolving the marriage of the petitioner No.1 and respondent No.2 are enclosed, along with the joint affidavit. 6. In the above facts and circumstances, no purpose will be served in continuing the criminal proceedings initiated against the petitioners.
