JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 3 17-01-2025 As these bail applications have cropped up from the same police station case number, hence, with consent of parties, they are being heard together and disposed of by this common order. Heard learned counsel for the petitioners and learned A.P.P. for the State. 2. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 127(1), 115(2), 117(2), 109, 103(1), 352 & 3(5) of the B.N.S. and Patna High Court CR. MISC. No.76441 of 2024(3) dt.17-01-2025 4/5 Sections 25(1-b)a, 26 & 35 of the Arms Act. 3. As per the prosecution case, the allegation against all accused persons including the petitioners is that they fired upon the nephew of the informant due to which he sustained gunshot injury and died. 4. Learned counsel for the petitioners submits that petitioners are innocent and have been falsely implicated in this case. The allegation levelled against the petitioners is not specific rather general and omnibus in nature. He submits that there is no specific allegation against the petitioners. He further submits that there is specific allegation of firing upon the deceased is made against Mohsin Khan and Khalik Khan. He submits that there is case and counter case between the parties and petitioners’ side have also sustained injuries and the informant has been granted anticipatory bail by this Court in the counter case. Petitioners have criminal antecedents as mentioned in para-3 of this application. 5. Learned APP for the State as well as learned counsel for the informant opposed the prayer for anticipatory bail and submitted that prayer for anticipatory bail of similar co-accused persons have been rejected by this Court vide order dated 12.12.2024 passed in Cr. Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned lower Court where the case is pending/successor Court in connection with Chainpur P.S.
