1. Learned counsel for the petitioner is permitted to make necessary amendment in the array of the parties during the course of the day.
2. Heard Sri Ramesh Upadhyay, learned Senior Counsel assisted by Sri Rajan Upadhyay, learned counsel, Sri Manoj Kumar Srivastava, learned counsel, Sri Varad Nath, learned counsel for the petitioners and learned Standing Counsel for respondents.
3. Since all the writ petitions have been filed against issuance of the notice dated 14.07.2025 issued by the Assistant Engineer, P.W.D. Rampur, they are being heard together and decided by this common order/judgement.
4. It is argued by learned Senior Counsel that by all notice dated 14.07.2025 issued by the Assistant Engineer, P.W.D. Rampur/respondent No.5 which are in a shape of
order, the petitioners were directed to vacate the land in question within a week from the date of receipt of notice otherwise, respondents will take action in the matter. It is argued that though detailed reply has already been submitted by the petitioners individually before the Assistant Engineer, P.W.D. Rampur and considerable time has already been lapsed but till date no decision has been taken in the matter.
5. On the other hand, it is argued by learned Standing Counsel that the respondent No.5 will take a decision separately in the matter expeditiously.
6. Heard learned counsel for the parties and perused the record.
7. In the facts and circumstances of the case, all the petitions are disposed of directing the petitioners to submit their individual fresh reply to the aforesaid notice along with certified copy of this order before the respondent No.5/ Assistant Engineer, P.W.D. Rampur, within a period of three weeks from today. In case, the petitioners do so, the respondent No.5 will pass fresh order within a period of six weeks thereafter separately.
8. For a period of three months or till the decision taken in the matter whichever is earlier, no coercive action be taken against the petitioners.
