NHAI Vs. Babu Ram & Ors. OMP(M) No.98 of 2023 09.04.2025 Present: Mr. Sumeet Raj Sharma, Advocate, for the applicant/appellant. None for respondents No.1, 3 and 4. Respondent No.2 ex-parte. OMP(M) No.98 of 2023 Respondent No.2 stands served. He has been proceeded ex-parte under order dated 25.03.2025 passed by the learned Additional Registrar (Judicial). 2. Respondents No.1, 3 and 4 were granted final opportunity to file reply on 18.07.2024. Reply to the application has still not been filed by these respondents. This leads to the inference that respondents No.1, 3 and 4 are not interested to oppose the prayer for condoning the delay made in this application. 3. For the cogent reasons explained in the application, delay as occurred in instituting the appeal is condoned. The application stands disposed of. Arb. Appeal No.85 of 2025 4. Be registered. List for consideration after four weeks. OMP No.329 of 2025 5. Subject to deposit of entire awarded amount alongwith up to date interest in the Registry of this Court within a period of four weeks, operation and execution of the impugned judgment dated 07.01.2022, passed by the learned District Judge Mandi, H.P. in Arbitration Case No.83 of 2018 (National Highways Authority of India Versus Babu Ram and others), shall remain stayed.
