JUSTICE MOHAMMAD NAWAZ ORAL ORDER Petitioner is seeking to enlarge him on bail in Crime No.286/2025 of Hebbagodi Police Station, Bengaluru City registered for the offence punishable under Sections 109, 3(5) of BNS, 2023. 2. Heard both sides and perused the material on record. 3. In the complaint lodged by Sri.Mahesh Kumar.S., it is alleged that on 31.05.2025, he had been to the birthday party of one Selvam (accused No.2), along with Teju, Govardhan, Chiku and Kundan. The said Selvam all of a sudden picked up a quarrel with him and abused him. On 07.06.2025 at about 9.30 pm, Teju @ - 3 - HC-KAR NC: 2025:KHC:31676 CRL.P No. 10536 of 2025 Tejas (accused No.1) telephoned to him and questioned him for raising voice in the birthday party and called him to his room situated in Anantha Nagara, Bengaluru. When the complainant along with his friend, Rahul went to the room of Teju @ Tejas; Govardhan, Chiku and Kundan were also present there. Teju @ Tejas (Accused No.1) stating that he has quarreled with his boys, assaulted him with a long on his right shoulder, Selvam (Accused No.2) assaulted with a long on his head and when he tried to escape, sustained injuries to his right hand. Others assaulted him with hands and kicked him and attempted to commit his murder. 4. FIR is registered against four named persons. The name of the petitioner is not in the FIR. It is alleged that others who were present, assaulted the complainant with hands and also kicked him, etc. 5. As per complaint averments, injured was provided first-aid treatment at one Oxford Hospital and then shifted to Best Hospital for higher treatment. It is - 4 - HC-KAR NC: 2025:KHC:31676 CRL.P No. 10536 of 2025 stated that a surgery was performed to his right hand. His statement was recorded in the hospital on 08.06.2025, on the basis of which, case was registered against accused Nos.1 to 4. 6. The specific overt-acts of assaulting the complainant/victim with weapons like long are attributed against Teju @ Tejas and Selvam. The said accused are arraigned as accused Nos.1 and 2 in the FIR. No motive whatsoever is alleged against the petitioner to commit the offence. It appears that on the basis of the voluntary statement of the co-accused, in the remand application, petitioner has been arraigned as accused No.5. He was arrested on 13.06.2025 and interrogation is completed. He is not required for further interrogation. No criminal antecedents against him has been brought to the notice of the Court. In the facts and circumstances, by imposing conditions, so as to safeguard the interest of the prosecution, petitioner can be enlarged on bail. Petitioner/Accused No.5 is directed to be enlarged on bail in Crl.Misc.No.5255/2025 pending before the III Additional District and Sessions Judge, Bengaluru Rural District, sitting at Attibele (Crime No.286/2025 of Hebbagodi Police Station), subject to following conditions: i) He shall execute a personal bond for a sum of Rs.50,000/- (Rupees Fifty Thousand only) with two sureties for the like-sum to the satisfaction of the Jurisdictional Court. ii) He shall furnish proof of his residential address and shall inform the Court, if there is change in the address. iii) He shall not directly or indirectly tamper with the prosecution witnesses. - 6 - HC-KAR NC: 2025:KHC:31676 CRL.P No. 10536 of 2025 iv) He shall not indulge himself in committing any offence. v) He shall appear before the Trial Court regularly on all dates of hearing.
