JUSTICE SATYAVRAT VERMA ORAL ORDER 2 05-02-2025 Heard learned counsel for the petitioners and learned A.P.P. for the State 2. The petitioners apprehend their arrest in connection with Chanpatiya P.S. Case No. 33 of 2024 registered for the offences punishable under Sections 147, 149, 385, 323, 324, 307, 327, 427, 504, 506 of the Indian Penal Code. 3. Learned counsel for the petitioners submits that the petitioner no. 1 and 4 have antecedent of three cases, petitioner no. 2 has antecedent of one case and petitioner no. 3 has antecedent of two cases. It is next submitted that petitioner nos. Patna High Court CR. MISC. No.1226 of 2025(2) dt.05-02-2025 2/3 1, 2 and 3 are women and the informant alleges that the accused persons including the petitioners came variously armed and started damaging the boundary wall of the informant. Further, when his father and uncle went to protect the boundary wall, they were threatened that how they have constructed the boundary wall without giving extortion, further Pramod assaulted the father of the informant by farsa on head causing injury while Aftab and Altaf had kept informant’s father on point of pistol, thereafter Fazil assaulted the uncle, Jatashankar of the petitioner causing injury on his head. 4. Learned counsel for the petitioners submits that from perusal of the allegation as alleged in the FIR, it would manifest that the specific allegation of assault is made against the Pramod and Fazil, but as far these petitioners are concerned no specific allegation of assault is made against them. It is also submitted that on account of dispute relating to land, the present case is came to be instituted. 5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner. 6. Considering the submissions made by the learned counsel for the petitioners, the petitioner above-named, in the event of their arrest or surrender before the learned Court below Patna High Court CR. MISC. No.1226 of 2025(2) dt.05-02-2025 3/3 within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Chanpatiya P.S. Case No. 33 of 2024 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. Jyoti Kumari/- (Satyavrat Verma, J.) U T
