Petitioner has been made accused in connection with Balumath P.S Case No. 71 of 2021, for the offence under Sections 147, 148, 149, 307, 120B of the Indian Penal Code, Sections 25 (1-A), 25 (1-B) (a), 26 (2), 27/35 of the Arms Act and Section 17 of the CLA Act, pending in the Court of learned Chief Judicial Magistrate, Latehar.
It is alleged that on 18.04.2021, on the basis of confidential information, Balumath police raided a place near Rajgurutola Jhiruhula where extremists had gathered. On seeing the police party, extremists opened fired upon them. Subsequently, they managed to flee away from the place of occurrence.
Learned senior lawyer for the petitioner submitted that the petitioner was not arrested at the spot. It was further submitted that no police personnel were injured in the said occurrence. It was finally submitted that similarly situated co-accused has been granted bail by this court earlier.
Regard being had to the facts and circumstance of the case, the petitioner named above, is directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Latehar in connection with Balumath P.S Case No. 71 of 2021.
