Heard Sri Virendra Kumar Maurya, Advocate, holding brief of Sri Ashfaq Ahmad Ansari, learned counsel for the petitioner, learned Standing Counsel for the respondents no.1 to 4 and perused the record. 2. In view of the order proposed to be passed herein, no useful purpose would be served by putting the private respondent to notice and keeping this petition pending before this Court. However, in case the private respondent feels aggrieved by the order his/her right to seek modification/variation of the order is being kept reserved. 3. The basic relief sought by the petitioner is to direct the respondent no.4 to decide the Election Petition No.502784 of 2021, under Section 12-C of U.P. Panchayat Raj Act expeditiously. 4. It is argued by counsel for the petitioner that election petition is pending considerat since 2021 and though a considerable time has already been lapsed but till date no final decision has been taken in the matter. 5. In the facts and circumstances of the case, present petition is disposed of directing the respondent no.4-Prescribed Authority/Sub Divisional Magistrate, Tehsil-Rampur Maniharan, District Saharanpur to decide the aforesaid election petition strictly in accordance with law most expeditiously and preferably within a period of three months but without granting unnecessary adjournment unless there is no legal impediment.
