PUBLIC PROSECUTOR The Court made the following: ORDER:- This Criminal Petition u/Sec.482 of B.N.S.S. is filed seeking to enlarge the petitioner on anticipatory bail in Crime No.119/2024 of Chinnamandem police station, Annamayya District registered for the offences punishable under Section 75(1)(ii), 78(1)(i), 79 of B.N.S. 2. Heard learned counsel for the petitioner and the learned Assistant Public Prosecutor for the State. 3. Learned counsel for the petitioner contends that the offences registered against the petitioner are punishable up to three years and as 2 seen from the accusation made in the report that the accused and the defacto complainant are friends and they used to move closely. 4. Learned Assistant Public Prosecutor submits that the police officials have already issued notice u/Section 35-3 of B.N.S.S. on 15.12.2024 and the same was served on the petitioner, but he has not complied with the notice. Learned counsel for the petitioner submits that in the event of issuing notice under Section 35-3 B.N.S.S., the petitioner would comply with the condition. 5. Therefore, in view of the aforesaid request, this Criminal Petition is disposed of, with a direction to the Investigating Officer to follow the procedure contemplated under Section 35-3 of B.N.S.S. scrupulously and in such an event, petitioner shall follow the same without any deviation.
