Present application under Section 528 of B.N.S.S. has been filed to quash the entire proceedings of Case No. 822 of 2022 (Smt. Minakshi vs. Himanshu) arising out of an application under Section 125 of Cr.P.C., pending in the court of Principal Judge, Family Court, Meerut. Learned counsel for the applicant submits that private opposite party no. 2 is able to maintain herself as she is working in Yusen Logistic (India) Private Limited Company, Gurugram, in capacity of a Manager since 2017 and she is earning Rs. 1,08,785/- per month. Questions is related to factual which was decided after evidence. Learned counsel for the applicant fairly admits that written statement has been filed by the applicant before the Family Court.
