ORAL ORDER
This petition is filed by accused No.1 under Section 483 of BNSS and Section 439 of Cr.P.C in C.C.No.2436/2018 arising out of Crime No.701/2017 of Rajagopalanagar Police Station registered for offences under Sections 399 and 402 of IPC.
2. Heard learned counsel for the petitioner and learned High Court Government Pleader for the respondent –State.
3. The petitioner earlier was granted bail in Crl.Misc.No.5726/2017 by the order dated 18.07.2017. Thereafter, the petitioner has been released on bail. The petitioner thereafter has attended the trial Court for some dates and subsequently, remained absent. The case against the petitioner came to be split up and now registered in C.C.No.2436/2018. The petitioner voluntarily surrendered on 01.09.2022 and he has been taken into

judicial custody. If it is submitted that the petitioner could not appear before the Committal Court as there was miscommunication between petitioner and his counsel. The petitioner has now deposited Rs.50,000/- towards forfeited bond amount of Rs.1,00,000/- on 12.02.2025 before the trial Court in S.C.No.1326/2025 which shall adjust the said amount towards forfeited bond amount and appropriate it to the State. The petitioner has undertaken to appear before the trial Court and cooperate for speedy disposal of the case. Considering the above aspects, the petitioner has made out case for grant of bail with conditions.
4. In the result, the following
ORDER i) The petition is allowed. ii) The petitioner is granted bail Crime No.701/2017 of Rajagopalanagar Police Station registered for offences under Sections 399 and 402 of IPC subject to following conditions:

a) The petitioner –accused No.1 shall execute a personal bond for a sum of Rs.1,00,000/- with one surety for the like sum to the satisfaction of the trial Court. b) The petitioner –accused No.1 shall not tamper the prosecution witnesses either directly or indirectly. c) The petitioner –accused No.1 shall attend the trial Court on all dates hearing unless exempted in co-operate for speedy disposal of the case. d) The trial Court shall appropriate the amount deposited by the petitioner in a sum of Rs.50,000/- towards forfeited bond amount of Rs.1,00,000/- to the State.
