JUSTICE MICHAEL ZOTHANKHUMA ORDER Date : 05-03-2025 Heard Mr. MK Hussain, learned counsel for the petitioner, who submits that the petitioner is desirous of opening the “N.A.C. College of Pharmacy” at Noor Nagar, Village-Chota Rupahi, PO-Herapati, PS- Nagaon, District- Nagaon (Assam). The petitioner’s counsel submits that in pursuance to the said object, the petitioner has submitted two applications dated 03.01.2024 and 12.07.2024 to the Director of Medical Education, Khanapara, Guwahati, Assam, requesting him to issue a letter of Intent for opening the “N.A.C. College of Pharmacy” in terms of the Regulatory framework of the Nursing, Pharmacy and Allied Health Science Sectors in the State of Assm provided in the notification dated 07.11.2023 issued by the Commissioner and Secretary to the Government of Assam, Medical Education & Research Department. 2. 2. The petitioner’s counsel submits that the limited prayer of the petitioner is for a direction to be issued to the Director of Medical Education, to take a decision on the petitioner’s representations. 3. Mr. M Bhuyan, learned counsel for the respondent Nos. 1 to 6 submits that he has got no objection to the prayer made by the petitioner’s counsel. 4. In view of the consent of the parties, the Director of Medical Education, Assam is directed to take a decision on the petitioner’s applications dated 03.01.2024 and 12.07.2024, for issuing a letter of Intent to the petitioner, subject to the condition that a decision has not been taken earlier. 5. The decision should be taken by the Director of Medical Education, Assam Page No.# 4/4 within a period of 1 (one) month from the date of receipt of a certified copy of this order. If a decision is already taken by the Director of Medical Education, Assam, the same should be communicated to the petitioner. 6. The writ petition is disposed of accordingly.
