On the matter being taken up, learned A.G.A. pointed out that on the basis of three base cases, which are mentioned in the gang-chart, an F.I.R. has been lodged against the applicants on 12.06.2025 at Case Crime No. 0098 of 2025, Police Station Lohamandi, District Agra. It is next submitted that out of three base cases, applicant no. 2 has explained the criminal history of only two cases. So far as the base case being Case Crime No. 710 of 2024, U/s 303(2), 318(4) B.N.S., Police Station Sadar, District Agra, no explanation has been given by the applicant no. 2 in the instant bail application. In response, learned counsel for the applicants submits that due to over-right, the said criminal history of the applicant no. 2 could not be explained. He further submits that the applicants may be allowed to withdraw this bail application with liberty to file fresh bail application with better particulars. Learned A.G.A. has no objection to such prayer of learned counsel for the applicant. In view of the above, the instant bail application is dismissed as withdrawn with liberty as prayed for. Office is directed to return the certified copy of the documents, if any, to the counsel for the applicant after retaining the xerox copy of the same on record.
