This matter has come up for consideration on number of occasions. As there was no co-operation from the respondent by filing counter for early disposal, this Court was constrained to pass an order on 18.06.2026 directing the personal appearance of the respondent and to give effect to the proceedings dated 30.05.2025 whereby provisional pension was sanctioned in favour of the petitioner. 3.Today, when the matter is taken up for consideration, the learned standing counsel appearing for the respondent filed counter affidavit of the respondent and also submitted that the entire provisional pension payable to the petitioner together with arrears have been released in favour of the petitioner on 01.07.2026 and the benefits of the petitioner could not be settled as the disciplinary proceedings initiated against the petitioner under 37(b) of Tamil Nadu Housing Board Service Regulations, 1969 vide charge memo No. DC4/21133/2024-2, dated 21.11.2025 is still pending. 2/4 https://www.mhc.tn.gov.in/judis WP(MD). In the light of the above and taking into consideration the fact that the petitioner is being paid by provisional pension, the respondent is directed to take all necessary steps for conclusion of enquiry pursuant to the charge memo dated 21.11.2025 and conclude the same as expeditously as possible, at any rate, within a period of three months from the date of receipt a copy of this order and thereafter, depending on the result of the said proceedings, release all terminal benefits payable to the petitioner within a further period of four weeks. 5. Accordingly, this writ petition is disposed of.
