ORDER.- This Criminal Petition, under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed by the Petitioners/Accused Nos.1 and 2, seeking regular bail, in Crime No.ll of 2025 of Renigunta Railway Police Station. 2. A case has been registered against the Petitioners herein for the offence punishable under Section 8(c) read with 20(b)(ii)(C) of the Narcotic Drugs and PsychotropiC Substances Act,1985 (for short [the NDPS Act'). 3, Case of the Prosecution, in brief, iS that, On 28.01.2025, at about 4.30 pM, on receipt Of Credible information, the Mandal Magistrate Gum Tahsildar, Renigunta Mandal along With revenue Staff and RPF Sl reached the Renigunta Railway Station and Caught hold Of two male Persons, Seized 1,2 kgs of Ganja and Sizable intoxicating tablets from their possession and a Case has been registered against them. 4. Heard the learned COunSel for the Pet'ltiOnerS and learned Assistant public prosecutor representing the respondenvstate. perused the material on record. 5. Learned Counsel for the Petitioners would Submit that the Petitioners have been in Judicial Custody Since 28.01.2025. The Contraband alleged tO have been seized from the possession of the petit-loners is 1.2 kgs of Ganja. *- `.S Learned Counsel would furth-e[ submit that the petitioners are ready to furnish suretI'eS tO the Satisfaction Of the Court and by this time, most of the investigation may have been completed. Learned Counsel for the petitioners finally prays to allow the petition. 6. Learned Assistant Public Prosecutor would submit that the contraband seized from the possession of the petitioners is non-commercial quantity. Learned Assistant Public Prosecutor finally submits that the court may pass appropriate Orders. 7. Considering the submissions made, since it is non-commercial quantity of 1.2 kgs of Ganja and the petitioners have been in judicial custody since 28.01.2025, as crucial part of the investigation is completed by this time, this Court is I'nClined tO grant bail to the petitioner/Accused on the following conditions. i) The petitioners/Accused Nos. 1 and 2 shall be released on bail on executing a personal bond for Rs.20,000/- (Rupees Twenty Thousand only) with two sureties of the like sum each to the satisfaction of the special JudI-Cial Magistrate of First class, Railways, Nellore. ii) On release, the petitioners shall appear before the station House Officer concerned, twice in a week i.e., every sunday and Thursday between 10:00 AM to 5:00 PM, till filing of the charge sheet. 8.
