For Petitioner(s): T.Hemalatha For Respondent(s): A.Sumathy For R.7 RR.1 to 6 and 8 to 24 – No appearance 4/ https://www.mhc.tn.gov.in/judis TR CMP No. 1089 of 2025 ORDER Learned counsel for the 7th respondent brings to my notice that the petitioners, who are now seeking transfer have been set exparte before the trial Court and hence, nothing survives for consideration in Tr.C.M.P.No.1089 of 2025. 2. Learned counsel for the petitioners would however state that an application has been taken out for setting aside the exparte decree and written statement has also been filed along with the same. He would further contend that only in the year 2024, the petitioners have been impleaded as legal representatives of the deceased defendants 13 and 14 in the suit. He would further state that one Murugesan, who is a third party is threatening the petitioners not to attend the trial of the suit. 3. I do not see this as a ground for seeking the transfer. In any event, as on date, the defendants have been set exparte and therefore, Tr.C.M.P.No.1089 of 2025 cannot be maintained even from this angle. 4. In the result, the Tr.C.M.P.No.1089 of 2025 is dismissed. No costs.
