Learned counsel for the petitioner(s) submits that certain aspects were not presented before the authorities concerned so as to take appropriate decision qua the claim of the petitioner(s) for the grant of benefit of higher pension keeping in view the actual salary being drawn by the petitioners(s).

Learned counsel for the petitioners(s) further submits that the petitioner(s) intends to file a comprehensive representation with the AARTI SHARMA 2025.05.01 10:30 I attest to the accuracy and integrity of this document
CWP-9719-2018 (O&M) -3- & connected cases Provident Fund Authorities by submitting due stand of their employer for the consideration of the claim of the petitioner(s) and the authorities concerned may kindly be directed to decide the said representation in a time bound manner so that the petitioner(s), who have already retired from service do not suffer any prejudice.

Learned counsel appearing for the respondent-Provident Fund Authorities as well as State submits that in case, any representation is received from the petitioner(s), appropriate consideration will be given to the same keeping in view the facts of the present case coupled with the settled principle of law on the said issue and appropriate speaking order will be passed within a period of 08 weeks from the date of receipt of any such representation and in case, it is found that the claim of the petitioner(s) is feasaible keeping in view the settled principle of law, appropriate relief will be granted to them otherwise due reasons for the not accepting the claim of the petitioners(s) will be mentioned in the speaking order so passed, which
order will be conveyed to the petitioner(s) for their information and necessary action.

Learned counsel for the petitioner(s) submits that keeping in view the statement made by learned counsel for the respondents, present petitions may kindly be disposed of having been not pressed any further with liberty as prayed for.
