Khan, the learned counsel for the petitioner. Also heard Mr. R. J. Baruah, the learned Additional Public Prosecutor for the State respondent. 2. The learned counsel for the petitioner has submitted that by order dated 21.02.2025, the petitioner, was allowed to go on interim anticipatory bail by this Court in pursuant to the directions of this Court, and the petitioner has appeared before the Investigating Officer and has co-operated in the investigation. 3. On the other hand, Mr. R. J. Baruah, the learned Additional Public Prosecutor has produced the case diary of Goalpara P. S. Case No. 25/2025 and has submitted that the petitioner has appeared before the Investigating Officer and his statement has already been recorded by the Investigating Officer. 4. However, he submits that considering the fact that there are sufficient incriminating material against the petitioner of misappropriation of public money, the interim bail granted to the petitioner. 5. I have considered the submissions made by both the sides and have gone through the case diary. 6. Though, there are incriminating materials against the petitioner in the case diary, however, as the petitioner has complied with the directions of this Court and as he has co-operated in the investigation, this Court is of the considered opinion that if he continues to co-operate in the investigation, his custodial detention may not be necessary for fair completion of the investigation Page No.# 3/3 of the Goalpara P. S. Case No. 25/2025 7. Hence, the interim anticipatory bail granted to the petitioner by order dated 21.02.2025 is hereby made absolute subject to the condition Nos. 1 and 2 attached to the said order remaining intact. 8.
