HIGH COURT OF JUDICATURE AT ALLAHABAD CRIMINAL MISC. BAIL APPLICATION No. - 28763 of 2025 Court No. - 66 HON'BLE ASHUTOSH SRIVASTAVA, J. Heard Shri Lovelesh Kumar Verma, learned counsel for the applicant and Shri S.K.Rai, learned AGA-Ist, for the State respondent. At the very outset learned AGA-Ist, points out that in the present bail application the Stamp Reporter, in its report, has reported that on pages 67 to 72 of the bail application the seal of the Oath Commissioner and signatures of the deponent are missing. Learned counsel for the applicant has filed a supplementary affidavit stating in paragraph no. 3 thereof that on account of mistake of Oath Commissioner the seal could not be placed on pages 67 and 72 and the deponent could not make his signatures on the aforesaid pages i.e. 67 and
72. The supplementary affidavit appears to have been filed with an intent to cure the defect as pointed out by the Stamp Reporter. In the opinion of the Court filing of the supplementary affidavit would not cure the defect as pointed out by the Stamp Reporter. Moreover, as per the report of the Stamp Reporter pages 67 to 72 of the bail application the Oath Commissioner had not placed his seal and deponent had also not signed the aforesaid pages. Even in the supplementary affidavit in paragraph 3 averment with regard to the Oath Commissioner not making his seal and deponent not signing has been made with reference to pages 67 and 72 only while the report of the Stamp Reporter speaks otherwise. In the opinion of the Court the bail application in the present form cannot Versus Counsel for Applicant(s) : Love Lesh Kumar Verma Counsel for Opposite Party(s) : G.A. be entertained by the Court. Faced with the above, learned counsel for the applicant submits that he does not want to press this bail application and the same be dismissed as withdrawn with liberty to file a fresh bail application. Accordingly, the present bail application is dismissed as withdrawn with liberty as prayed. Office is directed to return the certified copies of the documents, annexed with the bail application, to the learned counsel for the applicant, after retaining on record the photo copies of the same.
Registry is directed to be more vigilant in reporting such matters and ensure that the bail applications with such defects may not be placed before the Court unless the defect has been removed. Registrar Compliance, is directed to ensure compliance of the order by the officials of the Registry/Stamp Reporter. September 12, 2025 Deepak/ BAIL No. 28763 of 2025 2 (Ashutosh Srivastava,J.)
